Vehicle Barge Conditions of Travel

The following conditions apply to all persons, vehicles, and goods transported by Amity Trader Pty Ltd between Victoria Point and Coochiemudlo Island.

Definitions

"We", "Us", "Our" means Amity Trader Pty Ltd, its servants and agents.
"You", "Your" means the passenger booked to travel.

Agreement to Terms

By booking our service or travelling on our vessel, you agree to these conditions. All ferry schedules and information are correct at the time of publishing; however, these are subject to alteration, sometimes without notice.

Passenger Responsibility

You warrant that you are acting as agent for each of the passengers who travel under this contract and undertake to ensure that all such passengers are aware of these terms and conditions.

Compliance with Crew Directions

At all times, you must accept direction by Us (master and crew) during loading, travel, and unloading. Drivers must accept direction by crew at all times during loading and unloading.
All vehicle engines must be switched off once the vessel is underway, unless by prior arrangement.
You must secure your vehicle during transit to ensure it remains stationary and agree to indemnify us for any damage or injury caused by your failure to do so.

Right to Refuse Service

We reserve the right to refuse to transport any person, vehicle, or cargo without giving reason. We also reserve the right to conduct a search of any vehicle or cargo and refuse to carry any person or cargo onboard the vessel where deemed undesirable, unsuitable, or dangerous.
All vehicles must have current vehicle registration and appropriate permits.
Dangerous goods must be declared prior to travel.

Service Changes

We reserve the right to cancel or vary a service or our schedule in any way without notice and without incurring liability. We also reserve the right to prioritise travel for emergency service vehicles and/or passengers as required.

Check-in and Boarding

Check-in time for vehicle ferry travel is a minimum of 15 minutes prior to departure. Due to loading requirements, we reserve the right to refuse boarding for vehicles that check-in after this time.
When travelling on an Amity Trader service, you must follow the instructions given by crew and behave in a way which is respectful of other passengers.

Fares and Charges

All fares and prices are in Australian Dollars. You agree to pay the tariffs and fares as notified by Us through publication. All fares are subject to availability, surcharges, blackout periods, and seasonal variations.
Always check your travel documentation for final prices. We reserve the right to amend fares from time to time.
Full payment is required at the time of booking.

Resident Specials
  • Resident Specials are available to permanent Coochiemudlo Island residents only. Proof of residency may be required upon request.
  • A resident is defined as a person who permanently resides on Coochiemudlo Island with their principal place of residence registered to an island address.
  • Resident Special fares apply to a standard car only (up to 5.4m in length). Oversized vehicles, trucks, and trailers are not eligible and will be charged at the standard tariff.
  • These specials are only valid for the specific date(s) booked and cannot be transferred to alternative dates.
  • Resident Specials cannot be combined with any other promotional offer, discount, or concession.
  • We reserve the right to withdraw or modify Resident Specials at any time without notice.
  • All general Conditions of Travel above apply equally to Resident Special bookings.

Payment

Full payment is required at the time of booking.

Booking Changes

Changes and cancellations to bookings are only permitted if requested at least 24 hours prior to scheduled departure. Booking changes may incur a fare adjustment which must be paid in full at the time of change.

Vehicle Dimensions

The overall dimensions of a vehicle must include the vehicle and any additional load that would otherwise change the length, width, or height of the unit, excluding side mirrors. The length of any trailer must be measured from the towball or hitch to the end of the loaded unit.

We reserve the right to refuse boarding for vehicles where the overall dimensions have been incorrectly declared.

Cancellation Policy

Cancellations are subject to the following terms:

  • Less than 48 hours’ notice:
    No refund or credit (100% cancellation fee applies)
  • 48 to 72 hours’ notice:
    75% of the booking value will be issued as a credit to use within 12 months (25% cancellation fee)
  • 3 to 29 days’ notice:
    90% of the booking value will be issued as a credit to use within 12 months (10% cancellation fee)
  • 30 days or more notice:
    100% of the booking value will be issued as a credit to use within 12 months
Statutory Rights

To the extent the Australian Consumer Law or any similar state law applies to this Agreement, certain conditions and warranties will be implied into this Agreement for the benefit of the Customer, and those conditions and warranties cannot be excluded, restricted, or modified.
If We are liable for a breach of a condition or warranty implied by the Australian Consumer Law, then to the extent permitted by law, Our liability to the Customer will be limited, at Our discretion, to either:

  • The re-supply of the goods or services; or
  • The cost of having the goods or services re-supplied.
Limitation of Liability

Except as provided in this Agreement, We will not in any circumstances be liable for any loss, damage, or injury of any kind arising out of or in any way connected with the performance of this agreement, however caused, including by way of negligence, breach of contract, breach of duty of bailment, or wilful act of Us, our employees, agents, or sub-contractors.
We accept no responsibility for loss of, or damage to, any vehicle being carried, or luggage, or for consequential damages arising therefrom whether sustained during on-loading/off-loading or transportation, and whether arising from negligence, malfunction of the vessel or other cause, except to the extent that the exclusion of such liability is prohibited by law.
Furthermore, You will indemnify Us against all claims and demands whatsoever by whomsoever made in respect of any loss, damage, or injury of any kind arising out of or in any way connected with the performance of this agreement, however caused.

Claims Process

Subject to Clause 8 above, if you wish to make a claim against Us in respect of services provided under this agreement, you must notify us in writing within two months of the date on which the carriage occurred or was scheduled to occur, otherwise your claim is barred.

Smoking

Smoking (including electronic cigarettes and vapes) is not permitted on a vehicle barge or on/at public passenger infrastructure including vehicle waiting points. Smoking is prohibited on all vessels at all times.

Alcohol and Drugs

Open alcohol is not permitted on the vehicle barge. Drugs are not permitted on a vehicle barge or on/at public passenger infrastructure including vehicle waiting points at any time.

Transportation of Animals

Animals are allowed on Amity Trader vessel services. To ensure the comfort and safety of passengers and crew, animals must be accompanied and restrained appropriately. The Master of the vessel has the authority to refuse to carry any animal deemed to present a risk to passengers or crew.

  • Dogs travelling on the vehicle barge must be under control with a lead at all times while on board.
  • Dogs travelling with walk-on passengers must be securely muzzled and kept on a lead, or transported in a suitable pet carrier or cage.
  • Dogs travelling in the back of utilities or other vehicles must also be properly restrained to ensure they cannot reach passengers or crew.
  • The captain or crew may refuse to allow the dog if the service is reaching capacity.
  • Dogs that are not clean, appear vicious or likely to annoy, threaten or inconvenience other passengers will not be allowed.
  • Dogs are not allowed on seats and must not obstruct passageways.
  • You should keep your dog away from other travelling dogs to ensure the safety and comfort of other passengers and pets
  • Animals other than dogs must be restrained in a suitable box, basket, or other container at all times while on board.
  • Livestock such as goats and pigs will not be carried; livestock should be transported within a vehicle.
  • Seating restrictions, containment, and muzzling requirements do not apply to certified guide, hearing, and assistance dogs.
Dangerous Goods and Hazardous Items

Dangerous goods must be declared prior to travel. Passengers are responsible for ensuring compliance with all applicable regulations regarding the transport of hazardous materials.
Inflammable liquids (other than fuel in a vehicle's internal fuel tanks) may only be carried in containers approved by Australian Standards. For more information about dangerous goods, visit business.qld.gov.au.

Privacy

Amity Trader Pty Ltd respects your privacy. Personal information collected at the time of booking will only be used for the purpose of providing our services and will not be disclosed to third parties except as required by law.

Governing Law

This agreement and the services provided are governed by the laws for the time being in force in the State of Queensland, Australia.
